FARMER'S MARKET RULES AND REGULATIONS
Section 1. Products to be sold:
A. Producer's who offer for sale articles for human consumption such as fruits, vegetables, nuts, berries, maple syrups, bakery products, and/or non-edible articles such as cut or potted flowers. The articles must have been grown, produced, or prepared by the individual selling at the market. No used merchandise or items are to be sold. Michigan charities, new clothing merchandise, new, fresh, and community-based items, arts and crafts, and any other items are subject to approval.
Section 2. Liability:
A. The licensee, and the person executing this license on behalf of Licensee, by execution of this license accepts all liability for quantity and marketability of their products and agrees to hold the City of Harbor Beach and all of its agents or employee's harmless from any liability of claim for damages or suits for or by reasons of any injury to any person or property resulting from acts or omissions by the Licensee, his agents or employees or third persons, from any cause whatsoever while in or upon the premises, and Licensee covenants and agrees to save harmless the City from all liabilities, by reason of any injury, liability, claim, suit or loss occurring or damages growing out of the same, and for the cost and attorney fees defending such claims.
Section 3. Location and Space:
A. The market will be located at the Murphy Museum grounds.
B. The spaces will be approximately twelve (12) feet by twelve (12) feet and be marked by a number. Spaces will be allotted on a first come, first serve basis. No sites will be reserved.
C. All spaces must be neat, presentable, and safe.
D. Venders needing electricity must supply their own cords.
E. There will be no parking on the side streets after unloading. All venders must park in the parking lot or on Water Street.
F. A designated smoking area has been established at the rear of the Murphy Museum for both, venders and shoppers.
G. Dog waste stations will be established.
Section 4. Regulations:
A. At the market, all food products shall be sold only pursuant to Huron County Health Department regulations with necessary permits to be obtained and posted by the seller, including proper labels as required the State of Michigan.
B. A Michigan Department of Agriculture License is required where applicable.
C. The licensee is responsible for any and all necessary licenses and permits, as they are needed.
D. The licensee shall be responsible to keep his/her space clean and remove all debris and waste at the end of each operation day.
E. All products offered for sale at the Farmer's Market shall be subject to inspection by the City Clerk or any authorized city, county, or state official.
F. No persons occupying a space in the public market shall sell, offer or expose for sale any unwholesome or spoiled product or provision of any kind in said market.
G. The Farmer's Market Manager shall make sure all venders have proper licenses.
Section 5. Season, Time and Day:
A. The season for operation shall be May 22, 2014 through October 2, 2014.
B. The market will be open from 2:00 p.m. until 6:00 p.m. every Thursday, with set up beginning at 11:30 a.m.
If venders are set up before 2:00 p.m. and customers are there, you may sell. No venders are to leave before 6:00 p.m. unless you have sold out, or in the case of severe weather.
Section 6. Permit
A. Permit should be posted and visible at all times.
